The integrity of Newbubbles rests on buyers and sellers adhering to this guidance on Intellectual Copyright, and any breach will be viewed as a serious threat to this integrity.

This policy is written in accordance with prevailing UK and European copyright legislation. Should there be disparity between information provided in this document and existing copyright legislation, the latter will always take precedence.
Definitions:

For the purposes of this guidance document, ‘Intellectual copyright’ is defined as the legitimate ownership of products and their associated trademarks and patents where this is applicable.

The owner of a copyright holds the exclusive right to duplicate, distribute and create derivative works from his work. Auction listings often contain text, photographs and the names/trademarks of companies which may be protected by copyright laws.
Selling and Copyright:

If you're selling on Newbubbles, you are responsible for the legality of any item you list and the description of that item. If your item or listing breaches Newbubbles policy or is reported to us by an intellectual property rights owner as infringing its rights, the listing may be removed from our site.

Sellers are not permitted to sell products where the intellectual copyright is owned by a third party unless they have the express permission to do so from the copyright holder. Sellers are not permitted to copy, edit, adapt, re-package, digitise, reproduce or re-sell media products for the purpose of selling on Newbubbles where they do not own the intellectual copyright for the product or have not obtained appropriate authorisation from the copyright holder. Newbubbles reserves the right to ask any seller to provide evidence of their copyright ownership for a product they are selling and/or or evidence that the seller is trading legally and legitimately under UK, European and wider copyright laws.

Sellers are not permitted to offer counterfeit or pirate goods under any circumstances. The term "counterfeit" describes fake goods. The term "piracy" describes the act of reproducing movies, music, books or other copyrighted works without permission from the copyright owner.
Listings:

Sellers must not prepare auction listings using the text and photographs created by another user unless they have that user’s express permission to do so. Sellers are therefore encouraged to use their own descriptions and photographs.

Sellers are not permitted to link to somebody else's picture (so it appears in their auction) without the owner's permission.

Sellers are not permitted to use the trademarks or logos of other companies to sell their products without the express permission of these companies.

Newbubbles does not and cannot review the items listed on our site prior to posting, nor are we experts in the products or legal concerns of third parties. Therefore, we cannot pre-approve items to be listed.
Buying and Copyright:

Buyers do not automatically gain intellectual copyright over products they have purchased through Newbubbles. Unless otherwise stated by the copyright holder, the copyright resides with the original author/owner of this work.

For products offered exclusively by Newbubbles, any other intellectual property rights in, on or associated with the products including without limitation trade marks and design rights ("intellectual property"), shall at all times remain vested in the company or its licensors and no such rights shall pass to the customer.
Breaches to this Policy:
Breaches of this policy may result in a range of actions, including:

Forfeit of eBay fees on cancelled listings

Limits on account privileges

Account suspension

Permanent exclusion

From time to time, this policy may be updated in line with changes to UK, European and/or pertinent worldwide legislation. Users will be informed 30 days in advance of a change in this policy.
